1. Acceptance of Terms

By accessing or using Cubby.moe (the "Service"), provided by BananaCrumbs LLC ("Company," "we," "our," or "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

3. Description of Service

Cubby.moe is a file-hosting platform that allows you to upload, store, and share files. We may, in our sole discretion, modify, suspend, or discontinue any part of the Service without notice.

4. Uploading Files: Prohibited Content

You agree NOT to upload, transmit, or share:

• Any content that exploits or endangers minors, including child sexual abuse material (CSAM).
• Extreme, graphic, or sexualized violence, gore, or content that is primarily intended to shock or disgust.
• Hate speech, harassment, or content that incites violence or discrimination against individuals or groups.
• Malware, viruses, spyware, ransomware, or any code intended to disrupt, damage, or obtain unauthorized access to data.
• Content that infringes or violates another party’s intellectual-property rights, including copyrighted works, trademarks, patents, or trade secrets, unless you have the legal right to do so.
• Personal data of third parties without lawful consent or any material that violates privacy or publicity rights.
• Any content that is illegal under applicable local, state, federal, or international law.

We reserve the right—but not the obligation—to review, monitor, or remove any content at any time, and to cooperate with law enforcement where required.

5. File Retention, Deletion & Company Access

Files uploaded to the Service are intended to be stored indefinitely ("forever"), unless removed due to violations of these Terms.

Deletion Policy:

• Registered Users: If you have a registered account, you may manually delete your files at any time through the Service interface.
• Guest Users: If you uploaded a file without an account, you must prove ownership to delete the file. Ownership verification requires you to match the IP address and User-Agent string recorded at the time of the original upload.

You acknowledge and agree that BananaCrumbs LLC may access, view, and analyze the contents of any file you upload at any time, including for the purposes of maintaining the Service, enforcing these Terms, or complying with legal obligations.

6. Privacy & Log Retention

We collect basic technical logs (including IP address, user agent, and timestamps) for security, analytics, and abuse-prevention purposes. Logs associated with uploaded files are retained for the lifetime of the file or for a minimum of 90 days, whichever is longer.

By using the Service, you consent to this data collection and retention. For more information, please review our separate Privacy Policy below.

7. Ownership & License to BananaCrumbs LLC

You retain all rights in the files you upload. By uploading a file, you grant BananaCrumbs LLC a worldwide, non-exclusive, royalty-free license to store, transmit, display, and otherwise use the file solely for the purpose of operating the Service and fulfilling these Terms.

8. Indemnification

You agree to defend, indemnify, and hold harmless BananaCrumbs LLC, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your (a) access to or use of the Service, (b) violation of these Terms, or (c) infringement of any third-party right.

9. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. BANANACRUMBS LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BANANACRUMBS LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED ONE U.S. DOLLAR (USD $1.00).

11. Modification of Terms

We may revise these Terms at any time. Material changes will be posted on this page or otherwise communicated to you. By continuing to use the Service after changes become effective, you agree to be bound by the updated Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Service or other users. Upon termination, all provisions of these Terms that by their nature should survive will remain in effect.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of such courts.

We collect different types of information to provide and improve the Service.

• Social Sign-In Data: When you log in using Discord, we collect your Email Address, Username, and Avatar URL. We do not store your password.
• Technical Logs: We collect basic logs including your IP address, browser User-Agent, and timestamps when you interact with the Service.

2. How We Use Your Information

• To create and manage your account.
• To verify ownership of files for registered users.
• To prevent abuse, spam, and security violations.
• To display your profile avatar and username within the application interface.

3. Data Retention

Account Data: We retain your email, username, and avatar for as long as your account is active.

Logs: Technical logs (IP and User-Agent) associated with uploaded files are retained for the lifetime of the file, or for a minimum of 90 days (3 months), whichever comes last. This extended retention is required to allow guest users to prove ownership and delete their files at any time.

4. Account Deletion

If you wish to delete your account and remove all associated personal data, please contact us via email at cubby@bananacrumbs.us. We will process your deletion request and remove your email, username, and avatar from our systems.
